GENERAL TERMS AND CONDITIONS OF PURCHASE
These General Terms and Conditions of Purchase regulate the use of the website 3ina.com (hereinafter "The Website") owned by 3INA Cosmetics, SL (hereinafter 3INA).
1. IDENTIFICATION OF THE OWNER.
3INA Cosmetics, S.L. is a commercial company with its registered office at Calle Doctor Fourquet nº3, 28013, Madrid, holding Tax Identification Number (NIF) no. B87141305, duly registered in the Commercial Registry of Madrid, Volume 32,836, Book 0, Folio 190, Section 8, Sheet M-591.070, Entry 1, and with email address hello@3ina.com.
The use of the Website and the placement of orders imply full and unreserved acceptance of these General Terms and Conditions of Purchase in the version published at the time of formalizing the order. Therefore, it is advisable for the client to read these General Terms and Conditions before proceeding with a purchase. These can be consulted at any time on this page.

The service is provided in Spanish, English, and co-official languages where applicable, and will address requests on business days, within the hours indicated in clause 10.
2. SCOPE OF THE CONTRACT.
These conditions apply to the sale of all products offered by 3INA through the Website, for shipments to the countries indicated therein. EU customers have rights harmonized by Directive 2011/83/EU. If you do not reside in the indicated countries, you may only acquire items through the online store if the delivery address of the order is located in one of the countries or territories indicated on the Website. 3INA informs that its website is intended exclusively for an audience over 18 years of age. 3INA reserves the right to cancel a customer's access account if fraudulent, speculative acts, or bad faith are detected in the use of this service.
3. PURCHASE LIMIT.
For security reasons, purchases exceeding 1,000 euros, or with more than 100 items per order, cannot be made. Customers interested in making purchases for a higher amount must contact Customer Service, where they will be provided with information regarding how to carry out the desired purchase.
4. PRICE.
The applicable prices are those indicated on the website on the date of the order:
- All prices include VAT or other applicable indirect taxes, depending on the country of destination.
- Shipping costs are shown separately before the final order confirmation.
-Before making the payment, the customer will view a complete summary with the total price, including taxes and transport.
You can consult this information in the Shipping and Returns Policy section. Prices are shown in euros, except for the United States and the United Kingdom, where they are shown in US dollars and British pounds respectively, including applicable tariffs where appropriate.
5. PAYMENT.
Payment will be made at the end of the purchase process and shall be an essential condition for its formalization. Under no circumstances may payment be made subsequently. Payment via deferred procedures such as cash on delivery or bank transfer is not admitted, in accordance with Art. 60 bis of the TRLGDCU. Accepted payment methods: Visa, MasterCard, American Express, Shop Pay, Apple Pay, Google Pay, PayPal, and Amazon Pay. In any case, the choice of payment method is made during the purchase process on the corresponding screen.
3INA uses secure payment systems from leading financial entities with the aim of offering maximum security. The customer must notify 3INA of any improper or fraudulent charge on the card used for purchases, via email, in the shortest possible time so that appropriate measures can be taken. Payment providers or issuers may adopt anti-fraud measures that may lead to the rejection of certain types of operations. 3INA is not responsible for the application of such security policies.
You will receive the invoice in paper format, although you may indicate to us at any time your desire to receive an invoice in electronic format, in which case we will issue and send the invoice in said format. 3INA warns that it will not be possible to subsequently modify sales invoices in compliance with current regulations.
6. DELIVERY.
The delivery period shall be a maximum of 30 calendar days from the date of purchase.
Estimated timeframe: 1–3 business days.
Shipping costs: Shipping costs are detailed during the purchase process. The customer shall pay the customs management fees, as well as the taxes and duties generated by the order.
Delivery incidents: Our transport provider will send an email indicating the day the delivery will take place. In the event that delivery cannot be made due to the recipient's absence, the transport agency will contact you by email to manage a new delivery. After two failed attempts, and more than 14 calendar days from the first delivery attempt, the process for its return to the warehouse will begin.
Orders may be subject to customs controls in the country of destination. These controls are completely independent of 3INA and may generate additional delays in delivery exceeding the estimated timeframes indicated. 3INA shall not be responsible for delays derived from the actions of customs authorities, inspections, detentions, or any other mandatory border procedure. In the event of a customs delay, 3INA will inform the customer as soon as it becomes aware and will provide, to the extent possible, the information available on the status of the shipment.
7. RETURNS AND WITHDRAWAL.
Return: due to a fault, defect, or receipt of an erroneous product.
Withdrawal: originating from the customer's decision.
7.1 Due to the special characteristics of certain products, the following must be taken into account:
Returns or withdrawals are not permitted for reasons of health protection and hygiene when the wrapper, packaging, or hygienic seal protecting the product has been opened, except for those that are defective or faulty.
The 14-calendar-day right of withdrawal provided for in these General Conditions applies in accordance with European Union regulations and, therefore, is only mandatory for customers whose habitual residence is in an EU Member State. For customers residing outside the European Union, the right of withdrawal will only be applicable when required by the mandatory legislation of the customer's country of residence, or when 3INA decides to offer it voluntarily under the same conditions as for EU customers. In the event that local regulations do not recognize a right of withdrawal, returns will be governed exclusively by 3INA's return policy and the legal guarantees applicable in each country.
Products to be returned must be duly packaged, in perfect condition, and unused: (i) Returns affecting nail polishes and aerosols must be carried out by a non-air transport service (ii) Packs are indivisible and their items cannot be returned separately.
7.2 Conditions, refund, costs and procedure:
Conditions (Withdrawal): You have 14 calendar days from receipt of the product(s) to withdraw from the contract without the need for justification.
Conditions (Returns): 3INA will respond to lack of conformity manifested within the period established by legal regulations.
Refund (Withdrawal/Return): 3INA will reimburse, where applicable, the corresponding amount, including the shipping costs of the initial delivery, without undue delay and, in any case, before 14 calendar days have elapsed from the date on which it was informed of the return. The reimbursement will be made by the same payment method used for the payment. However, we may withhold it until we have received the products, or until you have provided proof of return, whichever condition is met first.
Costs (Withdrawal): The customer will assume the costs of returning the product or products.
Costs (Return): 3INA will bear all return costs. In addition, the customer may choose between exchanging the product for another in perfect condition, for the correct item, or for a refund.

Once we receive your email, we will process the return within 2-3 business days.
8. PRODUCT AVAILABILITY.
If supply incidents occur or if products are out of stock, the customer will be informed immediately. The customer may opt to request another product of the same or lower value, or request a refund; in this case, 3INA will proceed with the refund of the amount of the product(s) out of stock without undue delay and, in any case, before 14 calendar days have elapsed. The refund will be made in accordance with the provisions of Clause 7.
9. WARRANTY FOR PURCHASED PRODUCTS.
All products have the legal warranty of conformity (3 years from the date of purchase) provided for in Royal Decree-law 7/2021, of April 27. To request the application of the warranty, the customer must contact Customer Service (Section 10), and 3INA must evaluate the incident, and where applicable, offer the solutions covered by the warranty: repair of the product; or replacement with an identical or equivalent product, in both cases, at no cost to the customer. In the event that repair or replacement is not a viable option, the customer may choose between a proportional reduction in price, or the resolution of the contract with a full refund of the amount paid.
The legal warranty of conformity of three years indicated in these General Conditions applies in accordance with Royal Decree-law 7/2021 and European Union regulations, and therefore is only mandatory for customers residing in the EU. For customers residing outside the European Union, the duration and scope of the legal warranty will be governed by the mandatory legislation of the customer's country of residence, and may differ in terms of the term, coverage, or solutions available. In any case, 3INA will comply with the warranty obligations resultantly enforceable in each jurisdiction.
10. CUSTOMER SERVICE.

Operating hours: 9:00 am to 6:00 pm, Monday to Thursday, and 9:00 am to 3:00 pm on Fridays. Furthermore, we provide official Complaint Forms at the disposal of consumers and users, which may be submitted to the postal and email addresses indicated above. You may request them by sending an email to hello@3ina.com. In the event of incidents affecting the delivery or availability of an order, 3INA will proactively inform the customer, indicating the nature of the incident, the expected impact, and the available options, including the right to a refund if applicable.
The 3INA Customer Service department will handle your complaint, which will be registered with an identification code, and will provide a response as soon as possible, and in any case, within a maximum period of 15 business days from its receipt. 3INA will provide the customer with an acknowledgement of receipt or proof of the complaint submitted, which will allow for its tracking until resolution. In the event that the complaint is not resolved, or is not resolved in a manner satisfactory to the customer, you will be informed of the alternative complaint channels available.
11. MODIFICATION OF THE GENERAL TERMS AND CONDITIONS OF PURCHASE.
3INA reserves the right to modify these General Terms and Conditions of Purchase at any time. The new conditions will be applicable only to new purchases made after their publication. No modification will affect orders that are already in progress.
12. FORCE MAJEURE.
The fulfillment by 3INA of all or part of its obligations shall be suspended in the event of an act of God or force majeure that prevents or delays fulfillment. Considered as such, in particular, without this list being exhaustive, are: war, riots, insurrection, social unrest, strikes of any nature, meteorological disasters, and supply problems not attributable to 3INA. 3INA will inform the customer of such an act of God or force majeure within seven days of its occurrence. In the event that said suspension extends beyond a period of fifteen days, the customer shall then have the possibility of terminating the current order, and the refund will then proceed under the conditions provided for in point 7 of these General Terms and Conditions of Purchase.
13. APPLICABLE LAW AND JURISDICTION.
These General Terms and Conditions of Purchase are subject to Spanish law. Without prejudice to the above, the consumer also enjoys the protection guaranteed by the mandatory provisions of the law of the country where they have their habitual residence. The parties submit, at their choice, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the customer's domicile.
The processing of personal data derived from online purchasing, account management, billing, and subscriptions is governed by our Privacy Policy and Cookies Policy, available on the Website.
