3INA Colour Club - Terms & Conditions

These general terms and conditions ("General Conditions") regulate the 3INA Colour Club ("Program") loyalty program of 3INA COSMETICS, SL, a commercial entity domiciled at Doctor Fourquet street no. 3, Madrid 28012, with NIF no. B-87141305.

These General Conditions detail the operation of the Program as well as the process for obtaining and redeeming Bunny points by Program Members ("Member").

A. REGISTRATION PROCESS.

The Member's account is personal and non-transferable and must be in the name of a natural person, of legal age and resident in Spain.

To join the Program, you can register through the 3ina.com website ("Store"), expressly accepting the General Conditions. Within 24 hours, you will receive a confirmation email or SMS with a link to the 3ina.com website, where you can find the updated version of the accepted General Conditions. These Conditions will be stored on an electronic medium, which will be available to you, in Spanish, at any time on 3ina.com.

Identification as a Member, when making a purchase in the online store, will in any case mean knowledge and acceptance of these Conditions. 3INA may contact you via e-mail, 3ina.com, SMS, phone, or letter.

B. PROGRAM OPERATION.

The Member must identify themselves as such each time they make a purchase in the Store. The volume of purchases will be recorded in the Member's account. For the purposes of the overall calculation of purchases, all purchases made on the same date will be considered as the same purchase.

C. PROGRAM CATEGORIES AND BENEFITS.

  • Categories

Participation in the 3INA Colour Club allows the customer, as a Member, to enjoy a series of advantages, depending on the Club category they belong to. There are three levels in the 3INA Colour Club, depending on the amount of purchases the Member has made during the previous 12 months:

Colour Newbie: up to 99 euros.

Colour Influencer: between 100 and 199 euros.

Colour Hero: over 200 euros.

At the end of the day, the general review process of the categories will be carried out, counting the amount spent during the 12 months prior to that day. If a level change is appropriate, the benefits associated with the new level will come into effect from the said update.

  • Program Benefits

By registering for the program and identifying yourself as a Member in the Store, you can enjoy the advantages explained below.

  1. Obtain Bunnypoints on the amount spent.
  2. Redeem Bunnypoints to pay for the purchase of products for sale in the Store.
  3. Exclusive advantages, benefits, and promotions of the 3INA Colour Club, according to the assigned level.

D. OBTAINING BUNNYPOINT REIMBURSEMENT

  • Obtaining.

The obtaining and redemption of BUNNYPOINTS is personal to the Member. BUNNYPOINTS are not transferable, nor redeemable for cash or other goods outside those specified in the Bunnypoints.

Members can obtain BUNNYPOINT Reimbursement for all their purchases made in the Store.

BUNNYPOINTS accumulate based on a percentage of the net amount (after deducting other payments with BUNNYPOINT Reimbursement) of purchases made by the Member, identified as such, in the Store. BUNNYPOINT Reimbursement can also be accumulated through certain actions carried out by the Member, other than the purchase of products, detailed below.

The Member will be notified of the BUNNYPOINT Reimbursement obtained, through the 3ina website and/or Customer Service Center. The update may take up to 72 hours.

The amount corresponding to shipping costs in online orders, packaging costs and/or gift wrapping generates BUNNYPOINT Reimbursement.

In case of a total or partial return of a purchase, it will be necessary to identify yourself as a Member, through email, along with the order number to cancel the BUNNYPOINT Reimbursement accumulated with said purchase. In the event that there is not enough BUNNYPOINT Reimbursement available at the time of cancellation, the maximum possible will be canceled.

In the event that BUNNYPOINT Reimbursement had been used in the purchase, it is returned in the following way: if the return is total, the BUNNYPOINT Reimbursement used in the purchase is reactivated, updating the validity/expiration date based on the new reactivation date. In the case of a partial return, the BUNNYPOINT Reimbursement corresponding to the returned items will be reactivated.

Once the Member has identified themselves, they can accumulate BUNNYPOINT Reimbursement through certain actions they carry out, other than the purchase of Products, and which are detailed below:

  • Validity and expiration of BUNNYPOINT Reimbursement.

The amount spent by the Member accumulates and the BUNNYPOINT Reimbursement will be generated automatically. The BUNNYPOINT Reimbursement will expire twelve (12) months from the day of its accumulation, and after this period, if the Member has not used it, it will be automatically deactivated. The Reimbursement assigned for the customer's birthday will expire one (1) month from the day of its accumulation, and after this period, if the Member has not used it, it will be automatically deactivated.

  • Redemption of BUNNYPOINT reimbursement.

BUNNYPOINT Reimbursement can be redeemed for discounts on purchases that the Member, identifying themselves as such, makes in our Store.

BUNNYPOINT Reimbursement is redeemed against the initial recommended retail price of the Product (taxes included).

BUNNYPOINT Reimbursement cannot be used to: (i) purchase a Gift Card. In the case of a Gift Card, BUNNYPOINT Reimbursement will accumulate for the person who purchases the Gift Card for the amount of said card. However, for the person who uses the amount of the Gift Card, no BUNNYPOINT Reimbursement is generated for purchases made using the received Gift Card;

BUNNYPOINT Reimbursement cannot be combined with other promotions or discounts.

BUNNYPOINT Reimbursement does not apply to Kits, mini products, lips for life, and All The Colours Palete.

The issued BUNNYPOINT Reimbursement is exchanged in a single transaction for products from our Store. BUNNYPOINT Reimbursement can be accumulated through different actions to redeem in a single purchase.

  • Claim for BUNNYPOINT Reimbursement.

If at any time the BUNNYPOINT Reimbursement accumulation or usage service has to be interrupted due to a communication failure caused by circumstances beyond 3INA's responsibility or due to system improvements, the Member will have the right to request accreditation of the unrecorded BUNNYPOINT Reimbursement (by presenting the purchase ticket that reliably proves the purchase made), but will not be able to benefit from the Bunnypoints services until communications are restored. Recording of purchases at a later time will not be allowed.

E. BUNNYPOINTS ADVANTAGES, BENEFITS, AND EXCLUSIVE PROMOTIONS.

Colour Newbie: Members belonging to this category will be able to benefit from the following advantages:

Colour Influencer: Members belonging to this category will be able to benefit from the following advantages:

Colour Hero: Members belonging to this category will be able to benefit from the following advantages:

F. CUSTOMER COMMITMENTS

  1. Identify yourself with your email to enjoy the Club's benefits.
  2. Communicate changes to your address, e-mail, or telephone number (if applicable), in writing to 3INA and/or the Customer Service Center.

G. 3INA COMMITMENTS

  1. Maintain the confidentiality of the provided data and its updates.
  2. Serve the Member through the Customer Service Center at 3ina.com

H. CANCELLATION

  1. 3INA reserves the right to revoke, freely and without prior notice, membership in the Program in cases where non-compliance with any of the Member's duties, non-compliance with the General Conditions, fraudulent, speculative, irregular or bad faith acts, or inactivity for a period exceeding 24 months is detected.
  2. 3INA reserves the right to initiate any legal actions it deems appropriate in case of detecting any of the behaviors described above. The Member may also cancel their membership in the program at any time, by communicating such decision in writing to 3INA and identifying themselves, as indicated in the Customer Commitments section.
  3. Cancellation of the program, under points 1 and 2 above, will result in the loss of all rights related to its use, automatically from the moment the Member status is lost.
  4. 3INA may cancel the Program at any time, after a period of 12 months without the customer having made any purchase, due to force majeure or unforeseen circumstances, due to legal or other impositions, and for company policy reasons. Only in this latter case of cancellation, the Member will have the right to use the accumulated points during the two months following the date of cancellation of the program, which will be communicated to them through 3ina.com.

I. MODIFICATION OF CONDITIONS

3INA may modify these conditions by communicating them to the Members, a requirement that the parties expressly agree is met by publishing the variations through 3ina.com. If the Member does not agree with the changes, they may notify 3INA of their decision to withdraw from the Club.

J. APPLICABLE LAW AND JURISDICTION.

These General Conditions are subject to Spanish law. The parties submit, at their option, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the Member's domicile.

K. DATA PROTECTION.

We inform you of the main aspects related to the processing of your data and where you can expand this information on privacy:

Data controller: 3INA COSMETICS, S.L (hereinafter 3INA).

Purpose: To manage membership in the 3INA Colour Club, likewise, we understand that, by voluntarily registering for the Club, you expect to receive information related to 3INA products, new collections, promotions, events, and market research. We inform you that we may create profiles for marketing purposes, to send you communications that may be of interest.

Legal basis: execution of the contract and legitimate interest.

Recipients: No data is transferred to third parties, except for legal obligation.

Retention periods: As long as you do not request your deregistration, since until then we will understand that you are still interested in being part of the Club.

Rights: The completion of all requested data is mandatory. The Member has the right to access this information, being able to rectify it, cancel it, limit it, oppose it, request its portability, as well as the right not to be subject to automated decisions, including profiles. You can exercise your rights at privacy@3ina.com.

You can contact the Spanish Data Protection Agency for additional information about your rights and you can file a complaint with the DPO, or, if applicable, with the competent Data Protection Control Authority, the Spanish Data Protection Agency (https://www.aepd.es), especially when you have not obtained satisfaction in the exercise of your rights.
